Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FITZ HERO, a cloud-based fitness business management platform provided by FITZ HERO (“we”, “us”). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the business you represent.

1. The service

FITZ HERO provides tools to manage members, class schedules, personal trainer appointments, packages, point-of-sale, and reporting for fitness businesses, along with a self-service Member Portal for the members of those businesses.

2. Accounts & responsibilities

• You must provide accurate information when creating an account and keep your login credentials confidential.
• The administrator of a business account is responsible for the staff accounts and permissions they create within that business.
• You are responsible for the accuracy of the member and business data you enter into the Service.
• You must notify us promptly if you suspect unauthorized access to your account.

3. Plans & payment

The Service is offered under the HOBBY, STANDARD, BUSINESS, and ENTERPRISE plans described on our pricing page, each with its own included features and, where applicable, a stated monthly price. Unless otherwise agreed in writing:

• New accounts may trial the Service free for 30 days.
• Paid monthly subscriptions are billed with a minimum commitment of 6 months.
• HOBBY, STANDARD, and BUSINESS plans support a single branch; multi-branch use requires the ENTERPRISE plan.
• Fees are payable in advance for each billing period. Continued non-payment may result in suspension of access.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in a way that infringes the rights of others.
• Attempt to access another business’s data, or probe, scan, or test the Service’s security without authorization.
• Interfere with or disrupt the integrity or performance of the Service.
• Upload data you do not have the right to store or process (for example, without your members’ appropriate consent).

5. Data ownership

You retain ownership of the business and member data you enter into the Service. We process this data solely to provide the Service to you, as described in our Privacy Policy. You may export or request deletion of your data at any time, subject to reasonable operational limits.

6. Intellectual property

The FITZ HERO software, branding, and website content remain our property. These Terms do not grant you any right to the underlying software beyond the right to use the Service as intended.

7. Termination

You may cancel your subscription at any time, subject to the minimum commitment described in Section 3. We may suspend or terminate access for material breach of these Terms, including non-payment or violation of the acceptable-use rules above. Upon termination, we will make your data available for export for a reasonable period before it is deleted.

8. Service availability & limitation of liability

We work to keep the Service reliable and available, but it is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service, and our total liability for any claim is limited to the fees you paid us in the three months preceding the claim.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Thailand.
